“The infernal hurricane that never rests / Hurtles the spirits onward in its rapine”

~ Dante, Inferno V, lines 31-32

Prologue {Lillibridge Elementary, c. 1971}

I can clearly remember that fateful day filled with lachrymose as if it were yesterday: a transcendent day inside the reading room of Ms. Mirandi’s fifth-grade at Lillibridge Elementary, Detroit, Mich. I was 10 years old. By “reading room” I mean a corner of the classroom decorated like a library. There were three or four nice decorative chairs, a small sofa, a Persian rug, a coffee table, a lamp and, of course, the epitome of that wonderful space … a bookshelf filled with classical books.

Dante’s ‘Inferno’

Two books I remember with an inexplicable clarity are John Milton’s “Paradise Lost” and “Dante Alighieri’s Divine Comedy – Hell, Purgatory, Paradise,” translated by Henry W. Longfellow, Illustrated by Gustave Doré.

This book became my obsession. While I didn’t know it then, this classic opus would also become my destiny.

Since a picture is worth a thousand words, I will focus on Doré’s pictures, for it was these exquisite etchings that pricked my soul, that convicted me that I, even as a little boy, was a sinner in danger of eternal hell like those tragic figures Doré illustrated in Dante’s “Inferno,” and therefore I needed to make a sober, rational decision based on both deductive reasoning and faith – to give my heart, my life, my soul to God.

God created my body, soul and spirit, and my spirit would never have rest in this life until I gave my soul back to its Creator who first gave it to me. Since my father abandoned me as a little baby I had issues of low self-esteem, loneliness and fear, which led me to foolish decision making, most prominently anger.

Dante wrote in Inferno VII, lines 115-116: “Son, thou now beholdest / The souls of those whom anger overcame …”

Page after page after page I read. Canto after canto after canto, like Dante’s guide, Virgil, I eagerly followed where his words took me. I bore witness to the unspeakable horrors of hell with a mixture of childlike wonder, fear and utter revulsion, yet I couldn’t stop reading that book every day … every way. I was obsessed with Dante, but more with the illustrations by Doré. It was like within those grotesque illustrations of horror and damnation I saw my very soul reflected back to me: THERE, lost with the millions of others who had died without God down through the ages captured by the genius of Doré as no artist ever could in the above-titled panel, “The infernal hurricane.”

Would this be my fate? Would I remain eternally lost inside this ghetto hell? Dante wrote in Inferno III, line 9: “Abandon all hope, ye who enter here.” Was my destiny already decided? If so, then should I follow the Siren song of the Greek Epicureans whose philosophy was: “Eat, drink and be merry for tomorrow we die”?

No, No, No! I rejected the zeitgeist of hedonism, for I saw its pernicious and life-destructive effects on the lives of the people I lived with in my neighborhood; inside the hopeless, racially segregated ghettos of Detroit after the 1967 riot – the pimps, the prostitutes, the pushers, the drug addicts, drunks, hustlers, and gangbangers … the idle, the lazy, the lost. This was my hell as I, like Dante and Virgil, passed by them daily as a little ghetto boy going to school. Therefore, I knew if I did what those people did I would end up in Dante’s Inferno, and I earnestly didn’t want to remain inside that abode of the damned. Yet, I also remembered a sermon of a preacher whose text was 2 Peter 3:9: The Lord is not … willing that any should perish, but that all should come to repentance.

Epilogue:

It was August 1976. I was 14 and about to start high school. Since I was starting a new chapter of my life, I felt it was time to get my eternal soul right with God. My mother, being a teacher, always had lots of books around. That day I found a Good News translation of the Bible in our basement and read it for several hours until I got to this passage in Acts 16 regarding St. Paul’s conversion of the Philippian jailer:

“… and brought them out, and said, Sirs, what must I do to be saved?

“And they said, Believe on the Lord Jesus Christ, and thou shalt be saved, and thy house.”

That Bible passage, joined with the classics I read years before in Dante’s “Inferno,” Milton’s “Paradise Lost” and other canonical works, compelled me to fall on my knees in my mother’s basement that fateful day of Aug. 8, 1976, and I invited Christ in my heart and asked Him to save me from my sins by the blood He shed for us all on Calvary’s cross … and He did.

Twenty nine years later, while traveling to see his grandmother, I was telling this story to my son, Stone, and he immediately said like the Philippian jailer, “Father, I want to accept Christ into my heart too!” I was taken aback and pulled the car over to explain in detail what this critical decision would mean. He assured me that he was ready. Not only was he 10 years old, the same age when I was compelled to follow God by reading Dante’s “Inferno,” the same work I made Stone read which drew him to God, but Stone also made his declaration to God under the Jewish Star of David at the same church (a former synagogue) where I first made my public declaration to God almost 30 year before. Stone didn’t know any of this information, for I never shared it with him, but God knew… and God remembered me.

Forty years after first discovering Dante in Ms. Mirandi’s fifth-grade classroom, my new two-volume book, “The Progressive Revolution,” contains cover art by Doré of Dante’s “Inferno.”

Soli Deo Gloria! (Glory to God alone!)

“We can and must write in a language which sows among the masses hate, revulsion, and scorn toward those who disagree with us.”

~ Lenin

Dr. Charles Krauthammer, a psychiatrist and noted Fox News conservative commentator, responded to Bill O’Reilly’s inquiry regarding leftist hegemony inside the Academy with these astute, historical observations:

KRAUTHAMMER: I’m not sure I think so – and I do go back to the 1960s when instead of a fringe protest here and there these radicals took over the universities; they occupy them. They dictated policy. The administrations caved in, the police stayed out. And then they did even something more effective. They realized, well, you know, coming in from the outside is really not going to do much. You get a little attention, publicity. But the left decided late in the 1960s, early in the 1970s, [to begin what was called] ‘The March through the Institutions.’ They got inside. They did it legally. They did it the right way. They got their Ph.D.s. They got appointments. They got tenure. They kept out conservatives.

Rudi Dutschke, the German student-movement leader, in 1967 reformulated Antonio Gramsci’s philosophy of cultural hegemony with the phrase Der lange Marsch durch die Institutionen (The Long March through the Institutions) – an overt war metaphor harkening back to Mao’s Long March (1934–35) of the Communist Chinese People’s Liberation Army. Democrat Socialists throughout Europe, Russia, South America and here in America used “The Long March through the Institutions,” where the working class, through persistence and force, would fabricate their own organic intellectuals and culture (dominant ideology) to replace those imposed by the bourgeoisie.

This bring us to the thesis of this column: America, we are currently living in the tragic aftereffects of the Lenin-Gramsci “Long March through the Institutions.” Take, for example, the recent trilogy of scandals now plaguing the Barack Obama administration:

The whistleblower testimony regarding the Benghazi deaths of Ambassador Christopher Stevens and three others on the 11th anniversary of 9/11;

The Department of Justice illegal phone monitoring of 18 Associated Press journalists and the illegal wiretapping of over 100 AP calls; and

The Internal Revenue Service targeting and blacklisting over 500 groups based on political ideology including tea party, conservative, Republican, Christian, Hispanic and Jewish groups by inhibiting the securing of 501(c)(4) nonprofit status as “social welfare” groups, which since March 2010 effectively amounted to Democratic Party voter suppression of Republican voters.

Here, I will focus my analysis on the latter scandal of IRS blacklisting of conservative organizations. Breitbart.com journalist Wynton Hall, in an essential article on the IRS case, wrote about a Marxist/progressive organization called ProPublica founded by radical socialists George Soros and Herbert and Marion Sandler – a group to whom the IRS gave classified tax records of conservative, tea party, Jewish and other GOP-allied organizations.

In his article, titled “Progressive Group: IRS gave us conservative groups confidential docs,” Hall wrote:

ProPublica says the documents the IRS gave them were “not supposed to be made public”:

The same IRS office that deliberately targeted conservative groups applying for tax-exempt status in the run-up to the 2012 election released nine pending confidential applications of conservative groups to ProPublica late last year. … In response to a request for the applications for 67 different nonprofits last November, the Cincinnati office of the IRS sent ProPublica applications or documentation for 31 groups. Nine of those applications had not yet been approved – meaning they were not supposed to be made public. (We made six of those public, after redacting their financial information, deeming that they were newsworthy.)

The group says that “no unapproved applications from liberal groups were sent to ProPublica.”

According to Media Research Center Vice President for Business and Culture Dan Gainor, ProPublica’s financial backers include top progressive donors. …

Since the 1848 publication of Karl Marx’s “The Communist Manifesto,” history has repeatedly demonstrated that the Lenin-Gramsci “Long March through the Institutions” is an established Marxist/Socialist tactic and proven philosophical strategy to indoctrinate a comprehensive socialist hegemony throughout society (years before the Dutschke moniker was coined) by systematically deconstructing bourgeoisie capitalist culture and society rooted in Judeo-Christian traditions and by co-opting, taking over and eventually controlling all major societal institutions – not from without via violence and revolution as in Marxist/Socialist revolutions of the past, but within via Fabian Socialism – steadily, quietly, imperceptibly and with Nazi-like efficiency over a long period of time.

Historically speaking, “The Long March through the Institutions” is a cultural hegemony of Eurocommunism that has philosophically deconstructed and transformed all of the social sciences, by infusing activist polices of socialist, liberal and progressive politics throughout America, Europe and the world. The methodical discourse of cultural hegemony is vital to research and synthesis in sociology, political science, anthropology and cultural studies; in education, cultural hegemony devised crucial paradigms, by which the foundation of social and political discontent can be recognized, deconstructed and transformed.

Take a dispassionate view of history; pick any institution in American society and culture from law, religion, education, media, medicine, academia, to politics, journalism, labor, economics, science, business, the arts, modeling, Broadway, Hollywood, and I assure you that over the past 100-160 years all of these institutions have been systematically corrupted and perverted by evolution, atheism, Marxists, socialists, communists, liberals and progressives through their existential “Long March through the Institutions.”

Obama as a renowned public figure would not exist if this weren’t true.

Will men and women of good will stand up and united fight against this entrenched liberal fascism? Will patriotic Americans stand strong and begin to tear down these tyrannical walls of welfare statism FDR built in the 1930s and ’40s; that LBJ expanded in the 1960s and that Barack Obama with Saul Alinsky zeal marched through every American institution throughout the early 21st century?

How Christians, Republicans and conservatives deal with these three big Obama/Democratic Party scandals will determine the answer to these critical questions of modern times … indeed, for it will dictate our collective future.

Socrates (470-399 B.C.) was a famous Greek philosopher from Athens who taught Plato. Plato taught Aristotle, and Aristotle taught Alexander the Great. Socrates used a simple but cleverly profound method of teaching by asking revelatory, piercing questions. The Greeks called this form “dialectic” – starting from a thesis or question, then discussing ideas and moving back and forth between points of view to determine how well ideas stand up to critical review, with the ultimate principle of the dialogue being veritas – truth.

Note: This symposium is based on the biblical passages 1 Kings 22: 1-24 and 1 John 2:16. (For all that is in the world, the lust of the flesh, and the lust of the eyes, and the pride of life, is not of the Father, but is of the world.)

Characters:

Socrates

Jesus Christ

Satan

Demon No. 1 (Beelzebub, the chief demon)

Demon No. 2 (Hedonism = lust of the flesh)

Demon No. 3 (Evolution Atheism = lust of the eyes)

Demon No. 4 (Cult of Acceptance = the pride of life)

(Setting: Symposium of Socrates, inside the abode of hell)

Socrates: In this my blackest, diabolical symposium, we are gathered this dark night in Satan’s abode of hell to discuss a paradox of the ages: Why are the children of men so predisposed to cast away everything of value – logic, reason, friends, family, God, the Bible, the Constitution, a meaningful life, innocent little babies – to embrace the depraved Cult of Acceptance?

Satan: (meeting with his chief demons) For millennia we have plagued the children of men by setting at war of children against parents, husbands against wives, race against race, religion against religion, nation against nations. Forty years ago, I even raised up Justice William Blackmun to perform my will in a 7-2 Supreme Court decision, Roe v. Wade (1973). In a single generation, I resurrected the Doctrine of Molech, which had been dormant since the Dark Ages. I compelled humanity to commit global genocide against humanity. Nevertheless, the children of men have still multiplied upon Earth.

Demon No. 1 (Beelzebub): What can be done to destroy the sons of Adam so that the underworld and Earth can be brought together as thy united kingdom of evil, oh Satan? An empire to rival that of the God of heaven who in ages past cast us out down to Earth and imprisoned us in hell because there was sin found in thee – and in We.

Satan: Who will go to Earth to do my will? Who will go to avenge my evil against God, His Christ and the sons of Adam?

Demon No. 2: I will go! I am the Spirit of Hedonism. I will entangle the sons of Adam into the five “P”s: pleasure, porn, perversity, pedophilia, prostitution.

Satan: Have you ever heard of Hollywood? Next!

Demon No. 3: I will go! I am the Spirit of Evolution. Mankind prides itself on skepticism, naturalism, materialism, progressivism and science. Therefore, I will take a nobody atheist son of a Christian minister, send him on a long voyage to the remote islands of the Galapagos and fill his naive mind with scientific mythology of evolutionary atheism, kill truth and damn the world.

Satan: We tried scientific atheism in 1859 when Charles Darwin published the first edition of his “Origins of Species.” It kept many out of God’s kingdom, but I demand more souls!

Demon 4 (Cult of Acceptance): May I have a word?

Demons 1, 2, 3: (in unison) Who are thee?

Cult of Acceptance: I am the Spirit of the Cult of Acceptance. My techniques are so simple, my tactics so sublime, my strategies so effective that the sons of Adam have followed my primrose path to hell for millennia but never realized the error of their ways until it was too late!

Satan: What malevolent plan do you have to forever turn the heart of God against the children of men?

Cult of Acceptance: My plan is deviously simple. I will put a little thought into the mind of men. We call it “society.” With time, the sons of Adam will become obsessed with the idea of “fitting in” with society and its numerous institutions. It will dominate his worldview. It will cause him to curse God, neglect his family, truth, realism and let his Bible gather dust on his bookshelf – all for the fool’s hope of being accepted by some person, some prestigious institution, some group of people he doesn’t even know or care about.

Satan: Tell me more about this philosophy of worldview and fitting in.

Cult of Acceptance: My evil scheme isn’t original. I actually borrowed it from you, oh Lord Satan. It was you who gave these evil tactics and strategies to our good friends Adolf Hitler and the Nazis. They called it worldview (Weltanschauung) and coordination or bring into line (Gleichschaltung).

Satan: Yes! Yes! Now I remember. Oh, the devilish times we had killing those 6 million Jews during the Holocaust in addition to tens of millions of souls during World War II.

Cult of Acceptance: Yes, Lord Satan, but before we have a bringing together, we need a new worldview, and before we have a new worldview, we must have a paradigm shift, a game changer. We need humanity to first change its worldview from biblical theism to evolution atheism. Our useful idiot in England, Charles Darwin, achieved this for us. In 40 years, with the help of our dutiful foot soldiers, the college professors of the academy spread the lies of evolution, atheism, dialectical materialism, social Darwinism, including natural selection, survival of the fittest, the world over.

With this atheist worldview established throughout the Earth, it was easy to establish what the Nazis called Gleichschaltung, or bringing into line, which quickly morphed into forcing into line (at threat of death). Pick any cataclysmic event in the history of the world – paganism, slavery, abortion, the rise of Islam, the Crusades, the Enlightenment, the French Revolution, World War I and II. It all followed the same diabolical pattern, the same two simple techniques and strategies, Weltanschauung and Gleichschaltung. We murdered billions and billions and billions of people over thousands of years, which combined to form the Cult of Acceptance.

Socrates: Let us now hear the conclusion of this matter. Why are the children of men so predisposed to cast away everything of value – logic, reason, friends, family, God, the Bible, the Constitution, a meaningful life, innocent little babies – to join the depraved Cult of Acceptance?

Cowardice, fear, taking the easy road over the road less traveled, the praise of men are all good reasons, but I think it is an existential curse of human nature for the children of Adam to always want what they can’t have. It goes back to the Garden of Eden with Adam and Eve and the Tree of Knowledge of Good and Evil. It goes further back with Lucifer, the archangel of God who was above even archangels Gabriel and Michael, whose visage illuminated the kingdom of heaven, yet he convinced one-third of all the angels to become allied with him in his maniacal war against God.

Jesus Christ: At the start of my earthly ministry, I was in the wilderness fasting for 40 days and 40 nights when Satan, tempting me, took me to a very high precipice atop the mountain and in an instant showed me all the kingdoms of this world with its riches, fame, pleasures, power including the Cult of Acceptance. I told him, “Get thee behind me, Satan, for it is written thou shall have no other gods before me.”

What would it profit a man to gain the whole world and to lose his soul? And what would a man give in exchange for his soul?

Socrates: Answer: The Cult of Acceptance.

“During the reign of the Ku Klux Klan, they documented 5,000 deaths, during that 100-year reign [1865-1965]. In one week, 8,000 black people die, but they’re babies so they’re not counted.”

~ Pastor Levon Yuille

Last Sunday in downtown Detroit, about 45 anti-abortion protesters lined up outside Cobo Hall, where U.S. House Minority Leader Nancy Pelosi was the keynote speaker at the Detroit NAACP’s 58th Annual Freedom Fund Dinner – over 10,000 attendees. The protesters carried signs with slogans such as “Abortion Hurts Women,” “De-Fund Planned Parenthood” and “NAACP Wake Up! Abortion is Black Genocide.”

My radio show co-host and intellectual godfather, Rev. Levon R. Yuille, is also the director of the National Pro-Life Congress and the leader of the protest. He called on the NAACP to stop supporting “black genocide.” Pastor Yuille said he has led similar protests for the last six years at each of the Detroit NAACP’s annual diners. Of his reception to his protests, he said, “This crowd is very indoctrinated that’s coming to this dinner, to be perfectly honest. But there are some breakthroughs every now and then.”

The screaming headlines on the DrudgeReport told the tragic tale: “FDA LOWERS AGE FOR BUYERS OF PLAN B PILL TO 15.” America, now a 15-year-old little girl can go to her local drugstore, and right next to the candy bars, bubble gum and Tic-Tacs she can freely purchase the morning-after pill called “Plan B One-Step” to cleans her womb of all unwanted baby materials from “partying” the night before. Statics are demonstrative: 40 years since Roe v. Wade (1973) about 17 million little black babies have been murdered out of 58-60 million babies aborted in America. The worldwide abortion estimate since Roe is a staggering 1.72-1.80 billion babies!

The legalization of this genocide pill will make future abortion estimates impossible.

When did this black genocide start in America? About 104 years ago, the great black intellectual and founding member of the NAACP, Dr. W.E.B. Du Bois, was frustrated by Republican President Taft’s failure to address widespread lynching of blacks. Du Bois, who was Socialist Party member from 1910-12, therefore endorsed Democratic candidate Woodrow Wilson in the 1912 presidential race, in exchange for Wilson’s promise to support black causes. He was also secretly promised a job in the Wilson administration, which never materialized.

In a 1938 letter to Dr. Clarence Gamble, Margaret Sanger, the racist, eugenicist and founder of Planned Parenthood whose techniques and writings Hitler and the Nazis would later exploit to eradicate the Jews during World War II and the Holocaust, stated, “We should hire three or four colored ministers, preferably with social-service backgrounds, and with engaging personalities. The most successful educational approach to the Negro is through a religious appeal. We don’t want the word to go out that we want to exterminate the Negro population. And the minister is the man who can straighten out that idea if it ever occurs to any of their more rebellious members.”

Notice that Sanger said the ministers should be “hired.” There are many black ministers today who support abortion, and most of them still receive money from Planned Parenthood. These black false prophets have treacherously sold out tens of millions of little black babies for the Judas price of a traitor – “30 pieces of silver.”

Jonah Goldberg, in his milestone 2007 book, “Liberal Fascism,” wrote about progressives like Theodore Roosevelt, Woodrow Wilson, Walter Lippmann, Rexford Tugwell, Herbert Croly and even noted black socialists and progressives like Paul Robeson, W.E.B. Du Bois, Countee Cullen, Langston Hughes and other young writers of the socialist-contrived “Harlem Renaissance” who openly praised 20th-century tyrants.

For example, Goldberg chronicles Du Bois’ flattering admiration of Mussolini, Hitler and Nazism:

Before the Holocaust and Stalin’s doctrine of social fascism, liberals could be more honest about their fondness for fascism. During the “pragmatic” era of the 1920s and early 1930s, a host of Western liberal intellectuals and journalists were quite impressed with Mussolini’s “experiment.” More than a few progressives were intrigued by Nazism as well. W.E.B. Du Bois, for example, had very complex and mixed emotions about the rise of Hitler and the plight of the Jews, believing that National Socialism could be the model for economic organization. The formation of the Nazi dictatorship, he wrote, had been “absolutely necessary to get the state in order.” Hewing to the progressive definition of “democracy” as egalitarian statism, Du Bois delivered a speech in Harlem in 1937 proclaiming that “there is today, in some respects, more democracy in Germany than there has been in years past.”

As if celebrating Stalin, Mussolini, Hitler and the Nazis as a model for black improvement in America weren’t fanatical enough, for an encore, recalling his 1927 visit to the Soviet Union, Du Bois continued his servile propaganda of a Potemkin Progressive – “I am writing this in Russia,” he wrote back to his readers in the Crisis. “I am sitting in Revolution Square. … I stand in astonishment and wonder at the revelation of Russia that has come to me. I may be partially deceived and half-informed. But if what I have seen with my eyes and heard with my ears in Russia is Bolshevism, I am a Bolshevik [e.g., Communist].”

Remember, this man was the founding father of the NAACP. This communist demagogue even proudly accepted the Lenin Peace Prize in 1959!

President Obama, just Thursday, said that “he was comfortable” with his administrations’ decision to allow over-the-counter purchases of a morning-after pill for anyone 15 and older. Obama’s Nazi-like disregard for human life was foreshadowed in his presidential campaign rhetoric in March 2008 when he remarked about the possibility of his two young daughters getting pregnant: “I don’t want them punished with a baby.”

Since Roe v. Wade, 17 million little black babies denied their 14th Amendment due process rights disagree with you, Mr. President and Dr. Gosnell. I call that a majority opinion.

In 1909, Du Bois and a group of largely white progressives founded the NAACP, which in addition to championing “civil rights” has given black America 104 years of perpetual ghetto life, promoting tribal groupthink, Nazi-like fidelity to black infanticide and voluntary servitude on the Democrat Party plantation. Thanks NAACP – the National Association for the Abortion of Colored Peoples. You have made Margaret Sanger and the KKK proud.

“Universities exist to transmit knowledge and understanding of ideas and values to students not to provide entertainment for spectators or employment for athletes.”

~ Milton Friedman

Eden Alice Washington is my 11-year-old daughter. The other day I asked her if she listens to pop singer Beyonce. She answered, “No! I don’t listen to that kind of music.” She doesn’t like Obama, she already considers herself a conservative, and she’s curious about Christianity. Eden’s generation – and that of her elder brother, Stone – will have their hands full turning back Obama’s Progressive Revolution.

While I love America the Beautiful, one thing that vexes me to no end about this country is the excessive notoriety black people get for trivial vocations like sports and entertainment while we ignore, even despise, philosophers, intellectuals, critical thinkers – people who throughout history have changed society for good while all sports and entertainers have contributed is contained in this wise aphorism by the Roman poet Juvenal: Two things only the people anxiously desire – bread and circuses.

For example, America throws away hundreds of billions annually to people who are functionally illiterate, people who can’t put two sentences together without saying, “uuuhhh,” “aaahhh,” “you know” or excessive stuttering. For bouncing a basketball, throwing a football, hitting a baseball or kicking a soccer ball, America, with Nazi-like efficiency, will search out the worst ghettos and barrios, traverse the deepest, darkest jungles of Africa, South America, Cuba, Haiti, the Caribbean Islands, and promise the world to a black mother while sitting in her living room trying to convince her and her fatherless son that playing basketball for the University of X will guarantee a life of fame and riches.

Come on, America! Without the NBA, Shaquille O’Neill would just be a 7-foot-1, 376-lb buffoon, a janitor who thinks he is a rapper.

Yet these same good white folks, progressives, who are unfortunately the gatekeepers of society, won’t lift a finger to encourage little black boys and girls to go to the library, go to the bookstore, read books, write essays outside the required reading lists of your Progressive Concentration Camps most people call “public schools.”

Dare to think different thoughts, to covet higher ideals, to refuse to be numbered with the 96 percent of blacks who voted for Obama in 2008 and the 93 percent who voted for him in 2012. Blacks for 100 years, dating back to that racist President Woodrow Wilson (1913-21), have voted for the genocide of their own race led by Dr. W.E.B. Dubois and the NAACP. But why? The Cult Acceptance – blacks have a crippling fear of ostracism by whites, provoking an obsession of acceptance of whites that prevents blacks from escaping their self-imposed hell of ghetto life and tribal Groupthink our forefathers fought against to be free from slavery.

Remember the songs slaves sang in the cotton fields? Songs of liberty, songs of freedom, songs truth and deliverance like “Steal Away”:

Refrain: Steal away, steal away, steal away to Jesus! Steal away, steal away home, I ain’t got long to stay here.

Compare this old Gospel song slaves sang to get free in the 19th century with the lyrics to Beyonce’s latest musical pornography, “Bow Down,” which blacks (and whites) sing to become slaves in the 21st century:

I know when you were little girls

You dreamt of being in my world

Don’t forget it, don’t forget it

Respect that, bow down bit–-

I took some time to live my life

But don’t think I’m just his little wife

Don’t get it twisted, get it twisted
Bow down bit–-

Bow, bow down bit–-

Bow down bit–-
Bow, bow down bit–-

Family, not welfare, is the key to the emancipation of the black man in the 21st century. Yet, all I hear is Beyonce singing Bow, bow down bit–-.

I wonder how many of the tens of millions of little black boys and little black girls are blessed enough to be raised by two parents in America? And, if so, are their parents brave enough, enlightened enough, disciplined enough to teach their children to put down the damn basketball, football, baseball, to unplug the little Xbox, iPad, iPod that enslaves your mind with Siren songs of anti-beauty, gangsta lifestyle, glorification of death, destruction and sexual immorality? Turn off the TV sometimes, and make your kids read a book and write you a summary of that book.

With all the “education” black people are said to possess in modern times, how many blacks dare to emulate the intellectual skills, the beautiful life of a Harriet Tubman, a Republican who once famously said, “I freed a thousand slaves. I could have freed a thousand more, if they only knew they were slaves.” How many blacks pattern their children’s lives after a Frederick Douglass, a Booker T. Washington, a George S. Schuyler, the unsung black conservative intellectual/writer from the 1920s-60s, or in modern times: a Dr. Ben Carson, a Dr. Thomas Sowell, a Dr. Walter E. Williams, a Pastor Levon Yuille, or my direct intellectual descendant, Justice Clarence Thomas?

And you wonder why for 40-50 years more black young men languish inside the brutal hellhole of prison or are entangled in some element of the penal system (i.e., probation, parole, half-way houses, juvenile, sexual deviant lists, etc.) than are presently in college. While I am not a conspiracist, this modern American tragedy is not by accident. I believe it’s part of a grand, diabolical plot by the Liberal/Progressive Revolution to purposely deconstruct America and all of her sacred institutions, including God, culture, law, politics, economics and the family.

For over 100 years, for 30 pieces of silver to join the Cult of Acceptance by the left, black leadership has sold out the black masses by the tens of millions to abortion genocide, voluntary ghettos, public school concentration camps, welfare dependency and the slave chains of the Democratic Party plantation. This is the New Jim Crow.

Yet, all I hear ringing in my ears is Beyonce demanding that all who hear her voice, all those who hate her out there (I guess that includes me) … to Bow, bow down bit–- … and worship the useful idiots.

Summum ius summa inuria. (More laws, less justice)

~ Cicero, De Officiis, 1, 10, 33

America 2013 stands at the precipice of human history. Will Americans follow the progressive road to social, economic and moral perdition like their cousins in Europe have been doing since 1900, and increasingly since post-World War II, by embracing a seductive, gradual form of Marxism called “Fabian Socialism”? A “moral decay” is how Gibbon describes the fall of the longest-existing empire known to humanity. As it was with ancient Rome, so shall it be with America?

The fall of Rome has been a favorite topic of historians, especially since the publication between 1776 and 1788 of Edward Gibbon’s “The Decline and Fall of the Roman Empire” (six volumes). In his fourth volume, Gibbon lays out his thesis:

“… [T]he decline of Rome was the natural and inevitable effect of immoderate greatness. Prosperity ripened the principle of decay; the causes of destruction multiplied with the natural extent of conquest; and, as soon as time or accident had removed the artificial supports, the stupendous fabric yielded to the pressure of its own weight. The story of its ruin is simple and obvious; and, instead of inquiring why the Roman Empire was destroyed, we should rather be surprised that it had subsisted so long.”

In 1776, the year America boldly declared her independence from the tyranny of England under King George III, Gibbon had just penned his first volume of this magnum opus. In 1788, the final volume of his epic on the Roman Empire was completed. Just three years later America’s constitutional framers would ratify the Bill of Rights in 1791, including its transcendent First Amendment: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Note that the framers of the Bill of Rights, or the first 10 amendments to the Constitution, considered them to be Natural Law – in other words, unalienable, God-given, enumerated rights held by all people and thus natural rights that could never be lawfully taken away by any tribunal or man’s law (e.g., Positive Law).

In a 2005 law review article, I quoted Franklin, one of the most important contributors to the Constitution, to demonstrate how the framers diligently looked at the history of all known human governments, including Gibbon’s contemporary, comprehensive six-volume history, before they unanimously chose Natural Law, the integration of law and morality based on the Judeo-Christian traditions as the political philosophy and foundation of American law, jurisprudence and political leadership. In that article I wrote:

Hence, when the framers of the Constitution looked for a philosophy upon which to base this document, Benjamin Franklin summarized their sentiments quite aptly: “We have gone back to ancient history for models of Government, and examined the different forms of those Republics which having been formed. And we have viewed Modern States all around Europe.”

For most Americans, the First Amendment stands as the foundation of the Bill of Rights: limits on government Leviathan power to prohibit or compel religious beliefs, the right to have political opinions and freely express them, defense for a free press, the right to assemble peaceably and the right to petition the government, through protest or the ballot, for a redress of political grievances.

In addition, it is essential to realize that the First Amendment, like virtually all of the Bill of Rights, was not applicable to state governments until 1925 and to apply their substantive guarantees through the 14th Amendment, a process that did not begin until Fabian socialism and progressive radicalism crept into the Supreme Court beginning with Gitlow v. New York (1925) (ruling that the 14th Amendment extended the reach of certain limitations on federal government authority set forth in the First Amendment – specifically the provisions protecting freedom of speech and freedom of the press – to the governments of the individual states).

This pattern of leftist judicial activism from the bench would increase exponentially during the FDR/Truman eras (1933-53) as FDR’s bought-and-paid-for “New Deal” Supreme Court began out of whole cloth to create and propagate the so-called “incorporation doctrine” in many of its judicial decrees, starting with the infamous Footnote 4 of Carolene Products v. U.S. (1938) and going viral in Korematsu v. U.S. (1944) (holding that Japanese, Italians and Germans be placed in internment camps based on FDR’s Order 9066 during World War II).

Apply Gibbon’s warnings against the decadence of ancient Rome to modern America: “… the decline of Rome was the natural and inevitable effect of immoderate greatness. Prosperity ripened the principle of decay; the causes of destruction multiplied with the natural extent of conquest; and, as soon as time or accident had removed the artificial supports, the stupendous fabric yielded to the pressure of its own weight.”

This logically applies to the First Amendment by considering, for example, that until Gitlow, progressives hated the fact that Southern states before the Civil War outlawed pro-abortion literature; many states levied and collect taxes on behalf of state-sponsored churches and religious education; newspapers frequently were prohibited from publishing stories criticizing industry or certain connected political leaders because such speech was deemed seditious and consequently subject to prior restraint; and public protests regarding unpopular people or issues were repeatedly proscribed by state breach of peace laws.

Enter Pandora’s box – 40 years after Gitlow, in the 1960s, the Supreme Court began pushing its Darwinian, atheistic, progressive, anti-constitutional agenda and unleashed a nine-man sexual revolution using the incorporation doctrine to pervert the sexual mores of American society first in Griswold v. Connecticut (1965), which was based in part on the right of married couples to make decisions about contraception. Next was Roe v. Wade (1973) (legalized genocide of the pre-born), Lawrence v. Texas (2005) (legalized sodomy) and Hollingsworth v. Perry (2013) (Court will rule in June on whether same-sex marriage is lawful in all 50 states under Equal Protection grounds).

Paraphrasing Gibbon: The story of its ruin is simple and obvious; and, instead of inquiring why the Roman Empire was destroyed, or why America committed self-genocide, we should rather be surprised that it had subsisted so long.

“Those who sacrifice liberty for security deserve neither and will lose both.”

~ Ben Franklin

“The right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

~ Fourth Amendment

Welcome to President Obama’s brave new dystopian world of anti-Fourth Amendment fascism where he is pushing radical policies allowing the IRS to read your emails without a warrant; Senate Minority Leader Mitch McConnell, R-Ky., recently had his private office conversation illegally bugged, possibly by Democratic Party agents and published in Mother Jones (a la Nixon’s Watergate); and tens of thousands of drones are watching, recording and armed to bomb American citizens on American soil without judicial oversight or due process.

While the Fourth Amendment is often mentioned in connection with the Fifth, Sixth and Eighth Amendments – the other primary provisions of the Bill of Rights regarding the criminal due process guarantees of citizens – and is historically connected to the adoption of the Third Amendment to abolish the hated practice of British officers using the general writ of assistance to enter private homes, conduct searches and seize personal property of the American colonists. Under the tyranny of King George III, the British officers wantonly abused the private property of the colonists and were not required to put forward a single, specific reason to justify a search warrant or give a good reason for the taking of people’s personal property. In the majority cases, the writ of assistance was used to confiscate items thought to have violated the severe British customs laws of the colonial era.

The twin foundations of the Fourth Amendment, the probable cause and warrant requirements, are an expressed historical indictment against the hatred the framers had for the Revolutionary-era practices of English rule. However, similar to the First Amendment, the guarantees of the Fourth Amendment did not pertain to state and local law enforcement practices until well after the ratification of the 14th Amendment (1868). It wasn’t until almost 80 years later when FDR’s handpicked progressive activists on the Supreme Court in Wolf v. Colorado (1949) arrogantly ignored 160 years of judicial precedent (stare decisis) and marginalized the original intent of the constitutional framers, ruling that the 14th Amendment due process clause made the Fourth Amendment binding on the states (e.g., “Incorporation Doctrine”), whereby evidence seized in violation of the probable cause or warrant requirements could not be used against a criminal suspect.

The Incorporation doctrine is the most reactionary of judicial legislation commonly invoked by modern judges, which has essentially turned the U.S. Constitution into an activist document of progressive, socialist change over the past 70 years since FDR’s “New Deal Court” systematically devastated Natural Law, the Rule of Law, fundamental constitutional jurisprudence and the original intent of the constitutional framers – creating such unconstitutional, judicial politics as the following:

Footnote 4—Carolene Products v. United States (1938) (FDR’s Progressive Court summarily rejected 150 years of Natural Law jurisprudence [particularly the so-called ' Lochner Era': 1897-37] and out of whole cloth created minimal scrutiny [rational basis review] to economic regulations, and proposed new intermediate and strict scrutiny levels of review for certain other types of cases).

Korematsu v. U.S. (1944) (Court affirmed the constitutionality of FDR’s Executive Order 9066, which ordered Japanese [as well as German and Italian] Americans into internment camps during World War II regardless of citizenship). N.B.: This was the first case to implement the fascist jurisprudence of footnote 4 of the Carolene Products case.

Everson v. Board of Education (1947) (Court enacted the virulently anti-Christian doctrine separation of church and state).

Planned Parenthood of Southeastern Pennsylvania v. Casey (1992) (Court’s plurality opinion upheld the constitutional right to have an abortion [Roe v. Wade] and altered the standards for analyzing restrictions of that right, invalidating one regulation but upholding the other four).

Lawrence v. Texas (2003) (Court struck down in the 6–3 ruling the sodomy law in Texas and, by extension, invalidated sodomy laws in 13 other states, making same-sex sexual activity legal in every U.S. state and territory, thus launching a Second Sexual Revolution using same-sex marriage battles America is entangled in 10 years later in 2013).

National Federation of Independent Business v. Sebelius (2012) (Court upheld Congress’ power to enact most provisions of the Patient Protection and Affordable Care Act [ACA] and the Health Care and Education Reconciliation Act [HCERA], aka “Obamacare” including a requirement for most Americans to have health insurance by 2014).

The Court’s most controversial decision on the Fourth Amendment was Mapp v. Ohio (1961), which established the anti-constitutional exclusionary rule where critical evidence gathered by the police can be withheld from proving defendant’s guilt if a single judge deems the evidence “tainted” or derivative of the so-called “fruit of the poisonous tree.” This is judicial tyranny writ large!

Historically, the Bill of Rights, particularly the Fourth Amendment, was to be America’s last stronghold against liberal fascism. President Obama, who fashions himself as FDR, part 2, is moving toward establishing his own private (Gestapo) army, ordered the EPA and Homeland Security Secretary Janet Napolitano to buy (e.g., confiscate) billions of bullets, and is currently trying to pass a draconian anti-gun bill through Congress that amounts to a de facto deconstruction of our Second Amendment rights. Obama also has established a fascist drone program, which under the president’s dictates alone can order the bombing of American citizens on America soil without due process.

These unconstitutional Fourth Amendment violations are just part of Obama’s perpetual Progressive Revolution, designed since the 1860s to progressively push America into the abyss of economic, political and moral destruction while forcing this once-great nation to become a European-style socialist state where objective truth and science is killed by Darwinian evolution, capitalism killed by Karl Marx, the father of communism/socialism, God is killed by Nietzsche who in 1886 launched the “God is dead” movement fully embraced by early progressives, the Academy, liberals and atheists, and sexual chastity, the family and marriage killed by Dr. Pervert himself, Sigmund Freud, the father of psychiatry and psychoanalysis, while Judeo-Christianity is compromised and liberal fascism reigns supreme!

“I’m curious, when did it become unconstitutional to exclude homosexual couples from marriage? 1791 [when the Fifth Amendment was adopted]? 1868, when the 14th Amendment was adopted?

~ Justice Antonin Scalia

On March 26, during oral argument in Hollingsworth v. Perry, the controversial same-sex marriage case, Justice Scalia repeatedly questioned attorney Ted Olson on when restricting marriage to one man-one woman became unconstitutional. From the transcript:

JUSTICE SCALIA: I’m curious, when did it become unconstitutional to exclude homosexual couples from marriage? 1791? 1868, when the 14th Amendment was adopted? Sometimes after Baker, where we said it didn’t even raise a substantial Federal question? When did the law become this?

MR. OLSON: When – may I answer this in the form of a rhetorical question? When did it become unconstitutional to prohibit interracial marriages? When did it become unconstitutional to assign children to separate schools?

JUSTICE SCALIA: It’s an easy question, I think, for that one. At the time that the Equal Protection Clause was adopted. That’s absolutely true. But don’t give me a question to my question. When do you think it became unconstitutional? Has it always been unconstitutional? …

MR. OLSON: It was constitutional when we as a culture determined that sexual orientation is a characteristic of individuals that they cannot control, and that that –

JUSTICE SCALIA: I see. When did that happen? When did that happen?

MR. OLSON: There’s no specific date in time. This is an evolutionary cycle.

Olson wasn’t inclined to give a specific date or window of dates in response to Justice Scalia’s question. But Volokh Conspiracy readers have: Results of the VC reader poll from 2010 on when same-sex marriage became unconstitutional (at least among those who think it is currently unconstitutional) is available here.

As a black man and a blacklisted academic for 30 years, it was especially galling to me to hear “conservative” Olson’s reply to Scalia’s question using this sophistic argument: “When did it become unconstitutional to prohibit interracial marriages? When did it become unconstitutional to assign children to separate schools?”

This is how I would counter Olson’s arguments:

Since on any level (scientific, legal, moral) there isn’t any innate differences between blacks and whites (or any race), discrimination or policies enacted based on these non-differences is both irrational and unconstitutional. However, there is ample scientific, legal, moral and practical differences between men and women.

Miscegenation laws (e.g., Loving v. Virginia [1969], et. al.) were discriminatory and unconstitutional, although they existed in America for over 200 years. They violated Natural Law and the lofty guarantees in the Declaration of Independence, which promised that “All men are created equal.”

It would have been anathema for the civil rights movement and Dr. King, a Christian minister, a Republican and a strong Natural Law advocate, to march, bleed and die for “gay rights” or “same-sex marriage” in the 1950s and ’60s. This is shameless historical revisionism by the left. Even the Civil War amendments – the 13th, 14th and 15th – were enacted between 1865-1870 to realize the original intent of the constitutional framers that “All men are created equal.” These amendments had nothing to do with sex, marriage or gender.

What liberals, socialists and progressives understand all too well and conservatives, libertarians, observant Jews and Christians don’t seem to care that much about anymore is once you separate legality from morality (God) you put society on an irrevocable slide into the abyss.

Robert A. Levy, chairman of the libertarian Cato Institute, wrote an interesting essay on same-sex marriage in 2010. Here is an excerpt:

Whenever government imposes obligations or dispenses benefits, it may not “deny to any person within its jurisdiction the equal protection of the laws.” That provision is explicit in the 14th Amendment to the U.S. Constitution, applicable to the states, and implicit in the Fifth Amendment, applicable to the federal government.

Of course, government discriminates among its citizens all the time. By the 1920s, 38 states prohibited whites from marrying blacks and certain Asians. Until 1954, all states were allowed to operate segregated schools. Thankfully, the Supreme Court invalidated both interracial marital restrictions and school segregation. The court applied the plain text of the Equal Protection Clause despite contrary practices by the states for many years even after the 14th Amendment was ratified in 1868.

To pass constitutional muster, racial discrimination had to survive “strict scrutiny” by the courts. Government had to demonstrate a compelling need for its regulations, show they would be effective and narrowly craft the rules so they didn’t sweep more broadly than necessary. That same regime should apply when government discriminates based on gender preference.

Here, Levy is absolutely wrong! Anyone – conservative, leftist, atheist, pagan or statesman – who conflates racial discrimination in marriage, education, or employment with gender or sex is ignorant of both history and constitutional law. The Constitution, the Bill of Rights, the Abolitionist movement, the Civil War, the Civil War Amendments, Reconstruction, nor Jim Crow, the 1964 Civil Rights Acts or affirmative action had anything to do with the Lesbian, Gay, Bisexual, Transgender movement.

Being black isn’t a sin; being LGBT is a sin and violates many Bible precepts and the original intent of the framers. Perhaps Fox News host Bill O’Reilly would call me a “Bible thumper,” which I consider a vile, reactionary stereotype, yet O’Reilly must learn that all discrimination isn’t invidious or unlawful. Some discrimination is required to keep society from imploding.

Black Americans are collectively the beneficiaries of the blood, suffering and death MLK and the civil rights movement bore to fulfill Jefferson’s Declaration, yet over the past 40 years Black America has squandered this sacred inheritance because we allowed LGBT activists and other disparate groups to pervert the Bill of Rights and the 14th Amendment due process clause by glomming onto the black civil rights moral crusades of the 1950s and ’60s, which historically were rooted in God, biblical theism, Natural Law and constitutional liberty. This treachery is especially outrageous on the 45th anniversary of Dr. King’s assassination.

Is there a legitimate Fifth Amendment “right” to same-sex marriage? No. If America continues to allow an oligarchy of leftist, renegade judges using a Darwinian, atheist, evolutionary, “living constitution” paradigm to pervert the Constitution against itself, then the Constitution has become meaningless to uphold biblical principles and protect liberty, yet perfectly germane to social deconstruction and voluntary slavery.

Now, look at Hiroshima today. It’s not the wreckage. What happened? Well, people decided they weren’t going to allow their city to be destroyed forever… They needed help from the government, but it was the people, embracing the free market system, that revitalized Hiroshima.

– Glenn Beck

In February 2011, TV host Glenn Beck aired a provocative segment titled, “Hiroshima vs. Detroit: Which city really embraced the American dream?” I was born and educated in Detroit. Nobody enjoys viewing a video equating a city obliterated by an atomic bomb almost 70 years ago as light years beyond Detroit today, yet the truth is the truth.

Beck started his video discussing the so-called, American dream, which he contends has become a nightmare because the original American dream over the past 70 years, since FDR’s massive expansion of Leviathan government, has fallen victim to another progressive hijacking.

“The American dream that you dream about is the same opportunity for all. Give me a shot. Martin Luther King, Jr. talked about it. Give me a chance. Progressives have made it about the same outcome for all,” Beck said.

That’s contrary to “community organizer” Rev. Al Sharpton’s perverted logic that Martin Luther King’s dream was the same stuff in everybody’s house – houses for all, guaranteed jobs for all, guaranteed food and income for all. Marxism, redistribution of wealth, a socialist utopia!

Beck next pivoted to a comparative analysis of two notable cities: Hiroshima and Detroit. You recall that at the end of World War II, President Harry Truman dropped an atomic bomb on Hiroshima, Japan on Aug. 6, 1945, saving millions of allied lives. The atomic bomb completely destroyed 70 percent of the buildings in Hiroshima and by the end of the year, up to 140,000 had died. Virtually half of the city’s population, in total, died. Some 200,000 or more would eventually die from the effects, Beck detailed.

After showing several pictures of the utter obliteration of Hiroshima, Beck shows the miraculous pictures of Hiroshima today. It’s not the wreckage. What happened? Beck asks, “Well, people decided they weren’t going to allow their city to be destroyed forever. Yes, the government came in and helped rebuild the city, but what else could they have rebuilt from that destruction?”

They needed help from the government, but it was the people, embracing the free market system that revitalized Hiroshima … when Hiroshima looked like it did in destruction, this city looked like this. It was thriving. It is Detroit, Mich. But take a look at Detroit today. One city embraced the free-market system and the entrepreneurial spirit. The other embraced progressive policies and corrupt government and unions and companies that weren’t allowed to fail. …

They begged for a bailout and got one, and the union bosses did their share, too, whereas Hiroshima has nearly quadrupled in size since the attack. Not so much with Detroit. Less than 50 percent of Detroit’s peak population of 1.8 million in 1950 still lives in the city. Thirty-six percent of Detroit’s residents live in poverty. Detroit’s poverty rate is more than double than that of the entire U.S. as a whole. Eighty-one percent of the Detroit’s public school students qualify for free and reduced-price lunches in 2009 – 81 percent. As far as education, about 42 percent of Detroit’s public school students don’t even graduate – half.

Every public policy of the progressive revolution is specifically designed to perpetuate the slave master/plantation paradigm, to exercise absolute control over black America by white Democrat Socialist Party and keeping them – mind, body, spirit – on their hellish plantation called the ghetto or “inner city.”

For example, Richard Trumka, president, AFL-CIO, said, “I got into the labor movement, not because I wanted to negotiate wages. I got into the labor movement because I saw it as a vehicle to do a massive social change to include the lots of people. That’s why I got into the labor movement.”

Massive social change means establishing a European-style socialist state in America, but in part represents Democratic Socialist Party hegemony over black America by keeping them constantly angry, ignorant and fearful if they escape from the Democratic Party plantation that their reputation and career will be destroyed (e.g., Clarence Thomas, Allen West, Herman Cain, Dr. Ben Carson, etc.).

Detroit is what you get from 50 years of one-party, fascist rule.

Responding to Trumka, Beck said:

So it is not about your wages. It is about the progressive ideas. He believes in those ideas. Well, you can blame Ford and G.M., their bad corporate policies. And those policies, because of the progressives, weren’t allowed to reset. Nobody allowed them to fail.

Bad policies and union deals helped rot this city from the core. This is the path, America, that we are now embracing. We are embracing now a country that loves corruption, special favors, union deals and big unions and bailing out businesses that should have failed because they were run poorly. This city did what our country is doing now, embracing all the policies that led to this. But it doesn’t have to be this way. But you, the citizen, the shareholder in the United States of America, have to make the choice.

Our founders said that you could not live in a country and have freedom if the citizenry was uninformed. … We have to convince the American people that what happened in Detroit and cities like it can happen here in America and will. And we have to know and be able to show them the proof of who it was that led those cities there.

Lesson: History has demonstrated that a city like Hiroshima, Japan can fully recover from an atomic bomb attack 70 years ago, while Detroit lies in utter ruin after 50 years of Democrat Socialist Party rule, a majority black population approaching 90 percent, complicit black ministers, legions of Obama-type community organizers and corrupt, incompetent black leadership like Mayors Coleman Young, Dave Bing and Kwame Kilpatrick, the latter of whom presently sits in federal prison being found guilty on multiple counts of federal corruption, fraud and bribery charges while Detroit is shackled in perpetuity with a staggering $20 billion debt.

Hiroshima vs. Detroit: Who dropped the bomb on whom? For more than 100 years liberal/progressives have dropped the bomb of socialism, welfare slavery, anti-constitutionalism, mis-education and moral degeneracy on America while big cities across America like Detroit lay in smoldering ashes.

“The criminal is to go free because the constable has blundered.”

~ Justice Benjamin Cardozo

In their notes on the Sixth Amendment, O’Connor and Sabato’s textbook, “American Government: Roots and Reform,” wrote that it was “the centerpiece of the constitutional guarantees afforded to individuals facing criminal prosecution … [and] sets out eight specific rights, more than any other provision of the Bill of Rights.” Here is the full text of the Sixth Amendment:

“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.”

As with every provision of the Bill of Rights, the central foundation of the Sixth Amendment was specifically designed to fight against the unjust legacy and repressive policies of colonial-era England against her American colonists. The first condition of the Sixth Amendment is that criminal defendants or individuals subject to criminal prosecution must be given “a speedy and public trial”; it then requires that all such trials take place in public, with the defendant informed of the cause and nature of the allegations against them. The leitmotiv fundamental to these sections of the Sixth Amendment, in addition to those requiring prosecution witnesses to testify in public, giving the defendant the opportunity to produce favorable witnesses on their behalf and securing the assistance of counsel, is that any citizen arrested or denied their liberty be allowed to have the case made against them in public. The infamous, clandestine Star Chambers of England were outlawed.

While the Fifth Amendment also mandated the government to produce evidence that did not rely on forced or coerced confessions and self-incrimination through torture, it necessitated that all such evidence must be obtained lawfully and with the knowledge of a judge or public magistrate. The Sixth Amendment establishes, in principle, the American criminal justice system as one that is open to the public and to the press as affirmed by the Supreme Court in the case of Richmond Newspapers v. Virginia (1980).

Yet in modern times this storied history of the Bill of Rights has been severely perverted by what I’ve called the enduring, perpetual Progressive Revolution, whereby the greater part of criminal prosecutions in the United States are at the state and local levels. Thus to this end, all of the criminal-defendant rights and protections contained within the Sixth Amendment did not originally extend to most Americans until the early 1960s when the Supreme Court began systematically incorporating the guarantees of the Bill of Rights to the states through the 14th Amendment with the radical Warren Court (1953-69) followed by the Burger Court (1969-86). The vast majority of Supreme Court cases regarding criminal-defendant rights come during these two leftist, activist and largely unconstitutional judicial eras which has contributed greatly to deconstructing America’s Judeo-Christian traditions, Natural Law, culture and society while contributing greatly to America’s existential constitutional crisis.

Possibly the best-known case from this era relating to the Sixth Amendment is Gideon v. Wainwright (1963), which held that all persons accused of a serious crime are entitled to an attorney, even if they cannot afford one, a rule that was soon extended to cover misdemeanors as well, at taxpayers’ expense. Three years later, the Supreme Court combined the right-to-counsel rule established in Gideon with the Fifth Amendment prohibition against self-incrimination to create the principles animating Miranda v. Arizona (1966). Not since the creation of the Bill of Rights by the constitutional framers in 1791 had the Court ever interpreted the Fifth and Sixth Amendments to mean that individuals had rights to criminal due-process guarantees out of ignorance of the law or indigent economic status. Decisions such as Gideon and Miranda by leftist jurists systematically deconstructed and perverted the U.S. Constitution to create multitudes of new defendant “rights” out of whole cloth.

For over 100 years, progressives have favored leftist activist judges who disregard constitutional mandates in favor of a Darwinian, atheistic, evolving “living Constitution.” The first progressive head of state was Republican President Theodore Roosevelt (1901-09) who promptly nominated Oliver Wendell Holmes (1902-32) to the Supreme Court. Holmes is the greatest patron saint of the liberal/progressive left. With the election of Barack Obama in 2008, America has come full circle by willfully perpetuating this homegrown treason, this radical Progressive Revolution whose central goal is what Obama said in a 2007 speech, “to fundamentally transform America.” By “transform,” Obama and every progressive intends to deconstruct and destroy all of America’s Judeo-Christian traditions.

In a 2001 radio interview, Obama gave America a glimpse into the perverse mind of The Regime and what type of characteristics he considers in an ideal judge. Obama said, “… The Supreme Court never ventured into the issues of redistribution of wealth, and of more basic issues such as political and economic justice in society. To that extent, as radical as I think people try to characterize the Warren Court, it wasn’t that radical. It didn’t break free from the essential constraints that were placed by the Founding Fathers in the Constitution. …”

The most effective tactics liberal/progressives have used repeatedly to break free from the “essential constraints” of the Constitution was to enact the treason of the Progressive Revolution throughout every aspect of society via liberal activist judges and their anti-constitutional decisions. By appointing Sonia Sotomayor (2009) and Elena Kagan (2010) to the high court, Obama has openly shown his utter contempt for the U.S. Constitution, preferring evolutionary activist judges who legislate from the bench and share his tyrannous belief that the Warren Court (1953-69) didn’t go “far enough” in enshrining “redistributive change” (e.g., integrating Marxist/Alinsky socialist ideas in place of the rule of law into every area of society), thus effectively rendering the Constitution a dead letter.

Applying to the so-called “Incorporation Doctrine” whereby liberal activist judges apply many provisions of the Bill of Rights (including the Sixth Amendment) to the States through the 14th Amendment due-process clause is one of the most enduring yet ignored constitutional con jobs in the history of American jurisprudence – a move which for 50 years has literally given untold multitudes of criminals a key to their own jail cells … at taxpayers expense.
